Payroll Tax Problem Help in Bergen County
Unpaid payroll taxes are the IRS's top collection priority, because part of that money was withheld from employees' paychecks. The IRS can hold owners and others personally responsible through the trust fund recovery penalty. We deal with the business balance and your personal exposure.
Monday to Friday 10am to 6pm, weekends 11am to 5pm.
What we handle
The business and the owner, both protected.
The order you fix things in matters.
Unfiled payroll returns
Missing Forms 941 and 940 filed, with the deposits reconstructed from payroll records.
Current deposits first
The IRS will not agree to terms while new deposits are being missed. We get current quarters on track.
Business payment plans
Installment agreements for the business balance, sized to what the business can carry.
Trust fund penalty defense
Responsible-person and willfulness questions, the interview and the appeal.
Closed businesses
Closing the business does not end the trust fund penalty. We address it either way.
New Jersey and New York
State withholding filings and balances. Both states can also hold responsible people personally liable.
How it works
From exposure to a plan.
You authorize us
You sign a power of attorney, IRS Form 2848, online. From then on IRS notices come to us too, and we speak for you.
We map the exposure
We pull business and personal transcripts to see what is assessed, what is pending and who is at risk.
We resolve in order
Current deposits, then the missing filings, then terms for the balance and the penalty.
Common questions
Questions people ask first.
Can the IRS come after me personally if the business owes?
For the trust fund portion, yes, if you were responsible for paying it and willfully did not. That can include owners, officers and sometimes others with check-signing authority.
Should I go to the IRS interview?
Not without a representative. What is said in the Form 4180 interview is used to decide who gets assessed.
What if the business already closed?
The business balance may become uncollectible, but the trust fund penalty can still be assessed against individuals.
Do I have appeal rights?
Yes. The IRS sends Letter 1153 before assessing the penalty, and you generally have 60 days to appeal.
Behind on payroll taxes?
The first consultation is free. Call before the IRS interview, not after.
